I think he should be OU because it is just an offensive version of Latias.

I say OU only if he doesn't have Soul Dew which is why I think we should ban that item. But if it's not then Uber because he'll have to much power.

i say OU because really theres nothing to special about him compared to latias, except he has a better atk and worse defenses

As rezon said, latios is only a offensive version of latias, it´s base stats are too low to make it an uber.
